Software agreement/Terms of use
You agree to the following Terms of Use when you use Property Updater real estate software as a visitor or customer.

Definitions
"We", "Our", "Us" or "Property Updater" means Property Updater Limited;
"You", "User", "Customer" and "Customers" means you, the person using our products, services or visiting our Website;
"Services" means all products, goods or services we provide and anything else we do for you, including allowing you to access our Website;
"Service Availability" is defined as the ability to access and use the Property Updater software application.

Terms

  1. You must be a person. (Accounts registered or run through automated methods are not permitted).
  2. You must provide your full legal name, a valid email address and any other information requested by Property Updater in order to complete the subscription process.
  3. You are responsible for maintaining the security of your account login information (Username & Password). We cannot and will not be liable for any loss or damage from failure to comply with this security obligation.
  4. You may not use your account for any illegal or unauthorised purpose.

Account Billing, Invoicing and Refunds

  1. The credit card account you provide upon subscription to Property Updater will be charged your monthly subscription fee on the day you subscribe, and every year thereafter on the same day of the month (or the nearest business day, where applicable) for as long as you subscribe.
  2. Subscriptions are billed in advance on an annual basis, and are non-refundable. There will be no refunds or credits for partial years of service if you choose to cancel your subscription.
  3. You can view your account invoices and statements online when you are logged in to your Property Updater account.

Cancellation, Termination and Right to Monitor

  1. You may cancel your subscription any time. If you cancel your subscription, charges to your credit card will be stopped.
  2. No refunds are available for partial-year's subscription (for example, if you cancel the day after your annual billing date, there will be no refund for the year that's just been charged).
  3. We may monitor user account activity for any reason we deem necessary - including suspected illegal activity or uploading virus infected files, or for general customer support.
  4. We reserve the right to terminate accounts at our sole discretion.

Right of Refusal

  1. Property Updater has the right to accept or decline trial and paid account requests at our sole discretion.

Modifications to Service and Prices

  1. We may, at any time, make changes to the software functionality or release new versions of the software. Users will be notified when updates are made, and will instantly benefit from the upgraded software through their online account.
  2. We reserve the right to review and modify our prices at any time. Users will be given 30 days advanced notice of any price changes.

Integration

  1. Property Updater is integrated with Console® and SalesPartner for the purposes of transferring property listing data from either platform to Property Updater. Users must be legally entitled to use Console® or SalesPartner in order for Property Updater integration to be possible.

Service Availability and Support

  1. We will aim to provide service availability 99.9% of the time.
  2. In the event of an outage or access issue, we will act immediately to restore service access and retrieve data; however we cannot be held liable for data loss.
  3. Free phone and email support is available for Property Updater users. We aim to respond to support queries on the same day they are received during normal business hours (Monday to Friday, 9 a.m. - 5 p.m. New Zealand standard time). We will aim to answer queries submitted outside business hours on the next business day.

Code, Data Ownership & Liability

  1. Any data you enter in your account database remains yours.
  2. It is the responsibility of the user to review property listings to ensure data is displayed accurately within their website.
  3. All code, including the look and feel of the software is owned by Property Updater and may not be duplicated, copied or reused without our express written permission.

Subscription

  1. Property Updater is distributed as a web-based software subscription.
  2. A 'per user' license allows the purchaser to operate the software. User accounts are non-transferable.

Payment Currency

  1. Prices on this website are displayed in New Zealand dollars (NZD).
  2. Subscription fees will be charged in New Zealand dollars, which may incur foreign currency conversion fees for international credit cards - these are at the discretion of the credit card company, and are beyond the control of Property Updater.
  3. Foreign currency conversion rates are calculated using the conversion rate on the day of processing.
